The following are the terms and conditions for use of Mixcat Computers services and repair. Please read them carefully. Our service is offered to you with the condition that you accept without modification the terms and conditions contained herein Mixcat Computers may change these Terms of Service at any time, with or without notice. Accordingly, you should also check the Mixcat Computers website (at http://www.mixcatcomputers.com) to check for changes to the Terms of Services. You understand that by using the service after a change becomes effective, you have agreed to it. By selecting services from Mixcat Computers, you are indicating your agreement to be bound by all of the terms and conditions set forth in this document.

PRICING AND PAYMENTS: Mixcat Computers service pricing is available on the Mixcat Computers web site and at the time service is quoted by telephone, in-person, or via internet chat. You agree to pay the charges applicable to your selected service, as well as any applicable taxes and other charges including, but not limited to, activation fees, minimum service fees, no-show fees, fail to cancel fees, termination fees, other nonrecurring charges and set-up fees. You also agree to pay any additional charges or fees applied to your billing account for any reason, including but not limited to, interest, and charges due to insufficient credit or insufficient funds. (a) All payments are expected to be collected at the end of service. Upon completing service and repairs, the technician will explain to the customer what has been done and demonstrate that the problem described by the customer has been fixed.  (b) Cash, checks, and credit cards are accepted as forms of payments. There will be a $25 fee for any returned check.

SERVICE AND REPAIRS DONE AT Mixcat Computers LOCATION(S): (a) Standard service hours are Monday — Friday 9:30 A.M. to 6:30 P.M. Additional charges may apply for rapid response or service outside of standard hours. You acknowledge and agree that Mixcat Computers shall not be responsible under any circumstance for any loss or corruption of data and/or software, or damage to/loss of equipment during transportation. (c) Although Mixcat Computers will make every reasonable effort to schedule the delivery or pickup of equipment, you agree that any items left at any Mixcat Computers location longer than 60 days from the date of service completion may be sold or discarded without the customers consent, or charged a storage fee of up to $5 for every day stored beyond 60 days.

SERVICE LIMITATIONS; LIABILITY: (a) LIMITATIONS TO SERVICE  Mixcat Computers reserves the right to refrain from providing any or all requested services and instead refund your payment, wholly or in part, on the basis that your technical needs or other requirements are unusual or extensive and beyond the scope of this service agreement as reasonably determined by Mixcat Computers.

(b) FORCE MAJEURE: If Mixcat Computers’s ability to render services is impaired by you or circumstances beyond the control of Mixcat Computers, Mixcat Computers may choose not to provide or to discontinue services. (c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that Mixcat Computers’s  total liability for damages related to any of its services (including pickup and drop off) is limited to the total amount you pay for the services, and you release Mixcat Computers from liability for any indirect, incidental, special, or consequential damages, including any incident occurring during transportation of equipment. Mixcat Computers IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO PROPERLY USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

WARRANTY: Mixcat Computers warranties all service and parts against defects and omissions for 45 days from the date of service completion. The warranty covers only the specific work that was completed. Any unrelated problems which may arise are not covered by this warranty. Any problems with the specific work that was completed must be reported promptly. The warranty does not cover: operating system problems from the manufacturer (Microsoft or Apple), virus re-infection, effectiveness of anti-malware or security software, stability of any internet or network connections, any non-standard user settings or over-clocking of hardware, hardware or software problems that Mixcat Computers did not install, problems caused by illegal programs or activity on the computer, user error, systems that have not been picked up within the warranty period, or problems we have not been notified of within the warranty period. Our warranty is limited to repairing the original problem or replacing a defective part.. Refunds are not offered if warranty service is refused.

FORCE MAJEURE: Mixcat Computers shall have no liability or obligation of any kind, including, but not limited to, any obligation to deliver Products or provide Services, arising from any delay or failure to perform all or any part of this Agreement as a results of causes, conduct or occurrences beyond Mixcat Computers’s reasonable control, including, but not limited to, commercial impracticability, fire, flood, earthquake, lightning, storm, accidents, act of war, terrorism, civil disorder or disobedience, act of public enemies, problems associated with transportation (including car or truck shortages), shortages of energy or raw materials, acts or failure to act of any state, federal or foreign governmental or regulatory authorities, labor disputes, strikes, or failure of suppliers to make timely deliveries of materials, goods or services to Mixcat Computers.

YOUR RESPONSIBILITY: You understand and agree that prior to contacting or allowing Mixcat Computers LLC to perform diagnostic repair or other services on your computer or equipment, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that Mixcat Computers and/or its third-party service provider(s) shall not be responsible under any circumstance for any loss or corruption of data and/or software.


1.    I understand the information provided above and I am aware of the potential loss of data or damage to hardware or software that may occur while my computer is being repaired.

2.    I acknowledge and agree that Mixcat Computers rely on information I have provided them in repairing my computer. I acknowledge that Mixcat Computers will accept no liability for any loss or damage to my computer (including hardware or software) which arises out of incorrect or incomplete information provided by me.

3.    I acknowledge and agree that the liability of Mixcat Computers for any loss or damage to my computer (including hardware and software), however caused, is limited to the total amount paid for services. I have read and understand the limited warranty provided by Mixcat Computers.
*Most customers never loose data, this is a caution to always back-up!
